By downloading, installing, or using BluMnt ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
Description of Service
BluMnt provides hyperlocal weather forecasts, traffic updates, community chat, and local sports information specifically for Jefferson County, West Virginia. The App is designed to serve our local community with accurate, timely information.
Weather Information Disclaimer
⚠️ Important: Weather information provided by BluMnt is for informational purposes only. Weather data is sourced from the National Weather Service and other public sources. While we strive for accuracy:
- Weather conditions can change rapidly and unpredictably
- Forecasts may not always be accurate or complete
- Do not rely solely on this App for life-safety decisions
- Always follow official warnings from the National Weather Service
- In severe weather, use multiple sources and follow local authorities
User Accounts
To access certain features (community chat, personalized alerts), you may need to create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activity under your account
- Not share your account with others
Community Guidelines
When using community features (chat, posts, comments), you agree to:
- Be Respectful: Treat other community members with courtesy and respect
- Stay Local: Keep discussions relevant to Jefferson County and our community
- No Harassment: Do not harass, bully, or threaten other users
- No Hate Speech: Racist, sexist, homophobic, or discriminatory content is prohibited
- No Spam: Do not post commercial advertising or repetitive content
- No Misinformation: Do not spread false or misleading information, especially about emergencies
- Keep it Clean: No explicit, violent, or inappropriate content
- Respect Privacy: Do not share others' personal information without consent
We reserve the right to remove content and suspend accounts that violate these guidelines.
Prohibited Uses
You may not use the App to:
- Violate any local, state, federal, or international law
- Infringe on intellectual property rights
- Transmit viruses, malware, or harmful code
- Attempt to gain unauthorized access to our systems
- Scrape, harvest, or collect user data

- Reverse engineer or decompile the App

User Content
When you post content in the App (messages, posts, comments), you:
- Retain ownership of your content
- Grant us a license to display and distribute your content within the App
- Represent that you have the right to post the content
- Are responsible for the content you post
Premium Features
Some features may require a paid subscription:
- Subscriptions are billed through the App Store or Google Play
- Subscriptions auto-renew unless canceled
- Cancel anytime in App Store/Google Play settings
- Refunds are handled by Apple/Google per their policies
- Premium features subject to availability
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The App is provided "AS IS" without warranties of any kind
- We are not liable for any damages arising from your use of the App
- We are not responsible for the accuracy of weather data or traffic information
- We are not liable for user-generated content in community features
- Our total liability shall not exceed the amount you paid for the App
Indemnification
You agree to indemnify and hold harmless BluMnt from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
Changes to Service
We reserve the right to:
- Modify or discontinue features at any time
- Change pricing for premium features with notice
- Update these Terms of Service (we'll notify you of major changes)
Termination
We may terminate or suspend your account immediately, without notice, if you violate these Terms. You may delete your account at any time in Settings.
Governing Law
These Terms are governed by the laws of West Virginia, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Jefferson County, West Virginia.
